Your Legal Rights After You or a Loved One Suffered Injuries or Died from a Stroke Perhaps one of the most vexing problems regarding stroke in the U.S. is that most stroke victims could be spared from suffering lifelong disabilities if they are treated in time. Armed with this basic knowledge, one would think that the medical community would be able to bridge the gap of time between the occurrence of stroke and administering treatment. However, for a variety of reasons the gap remains wide, and for many, impassable, the results being that many stroke victims experience a multitude of injuries and afflictions that could otherwise have prevented. Therefore, it comes as no surprise that much of the research and planning being conducted by the healthcare community regarding stroke is now focused on drastically cutting the time between stroke and critical, early treatment.   If we put aside for the moment the fact that early treatment of stoke is often delayed because an inordinate number of stroke victims don’t get a proper or immediate diagnosis, we find that there are many things that can be done to improve response times and stroke outcomes. Every year, millions of people are injured in motor vehicle accidents. Car accidents are also the leading cause of brain and spinal cord injury in the United States. Motorcycle accidents cause about 20 percent of motor vehicle-related head injuries. Automobile accidents are often the subject of personal injury claims and lawsuits. Trip and fall accidents on public property or private property can result in serious injury, sometimes permanent. Many of these injuries are the result of faulty walkways or stairs or a property owner’s failure to maintain the property in a safe condition. Assaults by others can result in serious and debilitating injuries to victims. Sometimes, the person who commits the assault isn’t the only responsible party. Landlords and other property owners have an obligation to keep their properties reasonably safe. It can be difficult for an individual who is the victim of an assault to know all of the potential responsible parties. Injury victims may face lost wages, mounting medical bills, repair bills, and other out-of-pocket expenses. Aggressive, effective legal representation is your best choice when seeking compensation for your losses. $5,000 Flat-Fee Mediated Divorce

We meet in either our NYC or Uniondale offices for about one hour and go over the process of Listening, Educating and then Resolving Issues.  It may be more productive to sit with both the husband and the wife at the same time or speak with each separately.  I listen to each of your wants and needs and, of course, get an idea of the issues and finances involved.  I then educate each of you as to where I think you would end up if you litigated, and then we try and resolve issues in a manner that fits your lives and futures. With our Flat-Fee Mediated Divorce, a second meeting is included to continue to resolve issues as well as the drafting of the documents needed to obtain your divorce decree. 1st Meeting: We meet in either our NYC or Uniondale offices for about one hour. Lower Attorneys’ Fees for Medical Malpractice Cases

Under New York’s Judiciary Law, (“N.Y. JUD. LAW § 474-a : NY Code – Section 474-A”) attorneys’ fees in cases of medical malpractice are lower than the typical one-third fee for other personal injury lawsuits. Instead of one-third of the entire recovery being paid to the lawyer, the medical malpractice lawyer generally receives: 30 percent of the first $250,000 recovered; 25 percent of the next $250,000 recovered; 20 percent of the next $500,000 of recovered; 15 percent of the next $250,000 of the recovered, and; 10 percent of any amount over $1,250,000 recovered.   The statute that governs all medical malpractice retainer agreements is below.  If you have questions about any medical malpractice case, please call for a free consultation.   Search N.Y. Medical Malpractice: Failure to Diagnose and Properly Treat Strokes

Visit StrokeLaw.com.  A largest site on the web devoted solely to Stroke Victims and their Families 16-Year-Old Left to Die A 16-year-old suffered a major stroke in his brainstem and the doctors and hospital left him to die, because it was more than six hours from the stroke, and the clot-busting medications, according to the hospital, were only available to the child if he had been in that hospital during the first six hours. Instead of giving the child the life-saving medications, they gave him last rites and left him to die. Thank God, one doctor recognized the obvious: If he was going to die anyway, try the clot-busting drugs because it might save his life. After many, many hours, that doctor convinced other doctors to finally act. The clot busters saved the child’s life and, after many weeks of trial, the hospital finally capitulated and settled the case to avoid a jury verdict. “It was clear to me that the hospital, during the trial, realized that it should have tried to save the child’s life instead of simply letting him die.” —Cory Rosenbaum 60+-Year-Old Woman Dies After Doctor Fails to Recognize Signs of Stroke In this case, a woman Read more…

Representing Families of Children with Birth Injuries

I try to recover as much money as possible so your child will receive the best care for his or her entire life. I try to give parents the ability to rest assured that when they are gone, their child will continue to receive the best care. C-Section Done Too Late Children suffer brain damage when doctors do not do C-sections in time. Ignoring the Mother Children suffer brain damage when doctors don’t listen to mothers. Improper Use of Forceps Pulling the baby out: Babies get hurt by mistakes made with forceps and when they are pulled out. Loss of Oxygen Babies suffer brain damage when they don’t get enough oxygen during birth. Shoulder and Arm Injuries Called “shoulder dystocia,” the injury is caused by doctor error during delivery. Erb’s Palsy, Cerebral Palsy, and More Whether your baby suffered brain, nerve, or body damage during birth, it may be the result of a failure to monitor the mother before the birth, properly estimate the weight or size of the baby and head before labor, or an error during delivery.

Failure to Diagnose and Treat Cancer
Cases Against Doctors / Medical Malpractice

Failure to Diagnose and Treat Cancer

Breast Cancer Breast cancer is the second leading malpractice-related condition with most lawsuits arising out of misdiagnosis and delayed treatment. Colorectal Cancer Because it has no early symptoms, many cases of colon cancer are not diagnosed early. Colon cancer ranks 5th in malpractice lawsuits, with the typical claim over failure to diagnose early enough. Lung Cancer Lung cancer is sometimes misdiagnosed as something less harmful, making lung cancer the 4th most claimed malpractice injury. Prostate Cancer Prostate cancer has received a lot of press lately, primarily because it has quickly become the second-most common form of malignant tumor in men. Though potentially deadly, it is easily treatable if detected early. Rosenbaum  Brings Cancer Malpractice Into Focus Whether it’s a failure to diagnose, a failure to treat, or direct medical malpractice, Rosenbaum & Sanders employs leading medical experts in the fields of anesthesiology, breast cancer, colorectal cancer, lung cancer, and prostate cancer, as well as the latest courtroom technologies to ensure your case is presented in terms a jury can understand.
